Digiteka respects the privacy of its online visitors.

Digiteka (hereinafter referred to as “AS” or the “Software”) is a software-as-a-service (SaaS) available on the website www.digiteka.com. It means AS is available online to its Authorized Users, who can create, view, display and share interactive videos through the use of the Software’s rendering engine and through the AUs’ access on their web browsers. Please note that the terms and conditions of your AS’ License Agreement and of your applicable AS’ Service Level Agreement are the only one legally binding and as such, supersede and overrule any terms, conditions or declarations of this Privacy Policy.

The website www.digiteka.com is run and operated by Digiteka according to the website’s Terms of Use and Basic Support. Web users can also access other parts of the website www.digiteka.com and solicit information on AS pricing, ask for a free trial access to the Software or make any type of contact request.

When accessing, purchasing or using the Software online, for example by creating your User Account, as well as when using the other services of the website www.digiteka.com, you share information with Digiteka which can help us to make those services even better – to update you on the changes in the Software, to help you out when you are stuck at one step during the creation of an interactive video or to answer your information requests faster and better.

This Privacy Policy explains which information we’re collecting to what ends, the ways in which you can access and update your personal information.

Your information is controlled by Digiteka, a French company with its registered office at 21 rue Dautancourt, 75017 Paris, France.

  1. INFORMATION WE COLLECT
Irrespective of which country you reside in or supply information from, when using any of the services of the website www.digiteka.com or the Software, you consent to the collection, transfer, storage, disclosure and use of your information, in the United States, France and any other country where Digiteka operates.

We collect information to provide better services to all of our users – from figuring out basic things like which language you speak, to more complex things like which Software functions you like or not, or which Interactive Videos you might like or share.

We collect information in the following ways:

1.1 Information you give us.

Any use of the Software requires each of the Client’s Authorized Users to sign up for a dedicated User Accounts. When the Client or the Authorized User does so, Digiteka will ask for personal information, like your first and last names, company and position, email address, location, telephone number to store with your User Account. In return, Digiteka will generate and associate your User Account’s username and password, which you can change at any time.

Our services on Digiteka’s website will require the same personal information from you (pricing or free trial requests, contact). Please note that your personal information is needed for the full performance of the Software and/or the website’s other services. Should you not fill in the requested online forms or should Digiteka detects errors or wrong information, you may neither use the Software, nor use the website’s other services.

1.2 Information you give us.

We collect information about the services that you use and how you use them, whether on the Software or on the other parts of Digiteka’s website, like when you create a Project, Interactions or view and interact with Interactive Videos and their content. This information includes:

Device information

We may collect device specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). Digiteka may associate your device identifiers or phone number with your User Account.

Interactive Video Statistics

The Software is used by the Client for the online consultation of statistics on the use of the Interactions on each Interactive Video, such as the number of clicks, the time spent on each Interaction and/or on the Interactive Video overall and per unique visitor, the time between each click or the IP address.

Local storage

We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches. Digiteka only places one session cookie locally, which is deleted within a few hours after logout, and so far no other local storage is used or planned.

Location information

When you use Digiteka services, we may collect and process information about your actual location. We use various technologies to determine location, including collection your IP address or identifying your ISP. Digiteka may collect location information at the country level, mostly for language options purposes. We might extend this in the future to a city-wide level but it is neither implemented nor in development right now.

Log information

When you use our Software or view content provided through an Interactive Video, we automatically collect and store certain information in server logs. This includes:

  • details of how you used the Software, such as your creation and editions of Projects and Interactions, the associated time codes, the total time spent creating Interactive Video(s), time and date of your session, duration of your session;
  • details of how you provided access to Interactive Videos using the Software, such the number of clicks per Interactions and per Interactive Video, the total time spent by anyone watching the Interactive Video; associated search terms and other general statistics of use;
  • Internet protocol address;
  • device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request, the referring web page; and
  • cookies that may uniquely identify your browser or your User Account;
We collect Log information when you interact with Digiteka’s website or when you sign into Digiteka, interact with the Projects and Interactive Videos, use your User Account to access or share Interactive Videos with third-party websites or applications, or visit a third-party website or application that includes an embedded AS’ Interactive Video. When you edit online a video by creating Interactions, you use Digiteka buttons or widgets and we receive Log information that includes the widgets you use and how. We may associate Log information to your User Account should you be an Authorized User.

We collect Log information when you interact with Digiteka’s website or when you sign into Digiteka, interact with the Projects and Interactive Videos, use your User Account to access or share Interactive Videos with third-party websites or applications, or visit a third-party website or application that includes an embedded AS’ Interactive Video. When you edit online a video by creating Interactions, you use Digiteka buttons or widgets and we receive Log information that includes the widgets you use and how. We may associate Log information to your User Account should you be an Authorized User.

Maintenance and Hotline information

Digiteka runs maintenance services of the Software dedicated to its Authorized Users according to their Client’s License and SLA. When you use Digiteka’s maintenance services and/or hotline, we collect information such as the User Account or Client from which the maintenance request originates, the language, time and date of the unavailability request, the relevant error, the maintenance hours spent on resolving the error for the Client, the duration of unavailability, the number of maintenance hours of the Client before and after maintenance, any purchase or credit of maintenance hours, the telephone number used with the hotline and the number and duration of phone calls between the Client and Digiteka’s hotline. The Client may also, from time to time, provide feedback on its use of the Software, which will be processed as Maintenance and Hotline information.

The Maintenance and Hotline information may be associated to your User Account and to the Client to which it belongs.

Payment information

You may provide your payment information, including your credit or debit card number, card expiration date, CVV code, and billing address, along with your shipping address, to complete payments on the Software such as license royalties or purchase/renewal of additional services. To facilitate such purchases, we store your Payment information, excluding CVV code, shipping address, which you can remove from your Client’s User Accounts at any time using the Software’s settings. We also collect and store information created by your payment history, such as date, time and amount of the transaction.

You may provide your payment information, including your credit or debit card number, card expiration date, CVV code, and billing address, along with your shipping address, to complete payments on the Software such as license royalties or purchase/renewal of additional services. To facilitate such purchases, we store your Payment information, excluding CVV code, shipping address, which you can remove from your Client’s User Accounts at any time using the Software’s settings.   1. HOW WE USE INFORMATION WE COLLECT
We do not use your personal information for advertising services, whether directly or through third parties or partners. We collect the personal information listed above for the purposes to provide, maintain, protect and improve Digiteka services on the website and in the online Software, to develop new services and to protect Digiteka and its Clients. We also use this personal information to provide you with tailored assistance and recommendations, which you receive either after registering to the newsletter or by creating your User Account.

Digiteka uses personal information, and especially Log information, to provide, understand, and improve the Software services, and to make inferences, like what Software functions and Interactions you may be interested in.

Clients. Any use of the Software makes you a Client of Digiteka. Each Client has at least one User Account and associated personal information. You will not be registered as Digiteka’s Client until you actually begin to use the Software through one User Account. Personal information will be used to provide Clients with a tailored use of the Software, such as suggestions, training sessions on the Software, follow-up of your maintenance requests, feedbacks or any other associated services and processing and tracking of the purchases you made online. After you cease to be a Client of the Software and/or its associated services, Digiteka will process to the removal of your personal information from its servers in the terms and conditions applicable to the website visitors. Client information may however be archived up to five (5) years for evidence purposes.

Visitors. After you visit Digiteka’s website and use any of Digiteka services, excluding any use of the Software, we will either delete your personal information, remove any identifiers or aggregate data after a maximum of three (3) months. The deletion process is usually instantaneous but may vary according to our service providers’ server updates and refreshing protocols. Visitor information may however be archived up to three (3) years for customer relationship management and business development purposes.

Digiteka’s data processors may access such personal information in order to perform the requested services and purposes in the conditions set in the Sharing section of this Privacy Policy.

Whether you are using the Software through an User Account or simply using the other website services, Digiteka collects general statistics and Interactive Video statistics at all time. Such statistics are automatically generated either through our service provider Google Analytics or through the Software.

Through Google Analytics, we collect statistics, usually in non-identifiable aggregate form, like which pages are most frequently visited, how many visitors we receive daily, and how long visitors stay on each page, in order to help us identify the needs of our visitors and Authorized Users. Please see Information Security below for more details.

Through the Software, the statistics may be accessed by the Client who has created and shared the Interactive Video, but all personal information will be either made anonymous or aggregate (for instance, the Authorized Users will only see the number of end-users who viewed the video and clicked on the Interactions, calculated per each Interaction and per Project, the time between each clicks, on daily, weekly and monthly basis). Such statistics are automatically updated and generated every twenty-four (hours) by Digiteka servers, whether Interactive Videos are shared online or not.

We consider your Payment Information and shipping address private and do not make such information public. However, all purchases are made on the Software through a third-party payment services provider or card network to which we may transfer your Payment information for the strict purposes of the transactions. Furthermore, your Payment information may be used to track your offers and credits, especially the purchase of maintenance hours.

When you contact Digiteka with maintenance requests or feedbacks, we keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements.

We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.

We may use your contact information to send you the Digiteka newsletter, to market to you, to help prevent spam, fraud, or abuse, and to help others find your Interactive Videos, including through third-party services and Client applications. You may use your settings for email and mobile notifications to control notifications you receive from Digiteka. You may also unsubscribe from the Digiteka newsletter by following the instructions contained within the newsletter or the instructions on our website.

  1. COOKIES AND SIMILAR TECHNOLOGIES
A cookie is a small data file, typically made of a string of text and numbers, which assigns you a unique identifier and is transferred to your computer or mobile device.

Digiteka does not require cookies for many parts of its website and Software use. However, we use cookies to collect and store information when you visit Digiteka’s website and when you use the Software online, in order to collect additional usage data, including but not limited to identifying your browser or device, identifying your log session, and improving or customizing our services. We also use these technologies to collect and store information when you interact with Digiteka features that may appear on other sites, and to improve the overall quality and experience of Digiteka services.

All Digiteka cookies are session cookies and are permanently erased after you log out of the Software and exit the website, whether as a web user or an Authorized User. Such session cookies are sent to your browser so Digiteka addresses you in your own language, remembers your requests and keeps track of the webpages you viewed on our website. Digiteka does not use persistent cookies.

Digiteka uses Google Analytics’ products to analyze the traffic to its websites and software. Google Analytics’ products use cookies and similar technologies for these purposes, in order to better understand how you interact with the Software, to monitor aggregate usage and web traffic routing and to report on Authorized Users interactions. Such cookies may maintain persistent cookies to recognize you when you return to the website during a certain period of time. When used in conjunction with our website or with the Software, Google Analytics information is linked, by Digiteka or by Google, using Google technology, with information about visits to multiple sites, such as which search terms were used on which search website to get to Digiteka or on which website is the Interactive Video embedded.

Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to notify you when you received a cookie, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. You may also delete cookies already on stored on your computer through several means, either directly through your operating system’s file management software, or through the features of your web browser related to deleting your log data or your website history – for details, see AllAboutCookies.org.

  1. TRANSPARENCY, ACCESS AND UPDATE OF YOUR PERSONAL INFORMATION
Digiteka understands the growing privacy concerns in an expanding information society and the different expectations everyone can have regarding the use of their personal information.

Digiteka does not collect, associate with cookies or similar technologies, or use in any way whatsoever, personal information in connection with sensitive data categories such as those based on race, religion, police or judicial records, genetic or biometrics, mental and emotional difficulties, sexual orientation or health. Digiteka does not use State identifiers such as the identity card number, passport number or social security number.

Digiteka provides you with the possibility to follow the use of your information, and to modify it when needed in compliance with the applicable laws and regulations on personal data within the European Union.

On the Software, if you are an Authorized User, you can use the Software tools and settings to access and modify the personal information associated with your User Account at all times, to review and update the settings of your User Account to decide what type of date you would like saved with your UA or how your User Account appears to other Authorized Users or third parties, to enable or disable Digiteka’s newsletter, and to control or take out your personal information associated with our services, all within your Client’s policy restrictions.

On Digiteka’s website, the personal information you provided with your initial request to access or use our services may be accessed, modified or taken out on demand at the following email address: itsupport@digiteka.com or phone number: (+33) 1 42296071. We may ask you to verify your identity before we can act on your request.

In some jurisdictions, you may be charged a reasonable fee for access to information. In both cases, Digiteka undertakes to answer your personal data requests within reasonable time periods or to keep you informed in case of any Software or server difficulties lengthening its processing. In any case, Digiteka may reject requests that are unreasonably repetitive or automatic, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup systems). Any changes to your personal information collected or saved by Digiteka may take a certain time to be updated depending on our network and servers’ service providers. During this time, and up to twelve hours, you may restore your personal information if it was accidentally or wrongfully deleted.

Digiteka remains entitled to keep your personal information for legitimate business or legal purposes. You may contact us if you have questions about information maintained by us at itsupport@digiteka.com.

  1. SHARING INFORMATION
Digiteka uses a variety of third-party services to help provide its Services, such as hosting the website or your Interactive Videos and sharing them, to understand and improve the use of its services, such as whether a Software Interaction is really used or not.

These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. Third parties may share information with us, like a browser cookie ID, website URL visited, mobile device ID, or cryptographic hash of your User Account identifier and password, to help us measure and tailor Software functions. We may also receive information about you from our third-party service providers in order to help provide, understand, and improve our Services.

5.1 Information you share

Digiteka let you create and share Interactive Videos with other Authorized Users on the Software, but also with anyone you choose. Remember that the personal information associated with your User Account is also associated with the Interactive Videos you create.

  • When you share them exclusively within the Software, Digiteka strives to implement the appropriate means to protect your information.
  • When you share them publicly, your personal information will be listed publicly for all viewers, and it may be indexable by search engines and you provide your information at your own risk.
Keep in mind that search engines and other third parties may still retain copies of the personal information you made public, like your user profile information, even after you have deleted the information or deactivated your User Account.

Digiteka’s Clients may purchase Additional Services to use the Software’s rendering engine offline, as a way to control the display and sharing of Interactive Videos on their own servers and infrastructures themselves. By doing so, they become data controllers of your personal information. They do not rely on Digiteka’s services, website, servers or network, and must comply with laws and regulations on personal data at their own risks. This Privacy Policy shall only apply to the online use of the Software on or through Digiteka’s infrastructures. Please refer to Digiteka’s Client’s privacy policy for more information.

5.2 Information we share

We do not share personal information with companies, organizations and individuals outside of Digiteka unless one of the following circumstances applies:

With your consent. Digiteka will share personal information with companies, organizations or individuals outside of Digiteka when we have your consent to do so. We require opt-in consent for the sharing of any sensitive personal information.

With domain administrators. Your User Account is managed for you by Digiteka’s Client, which took the license and acts as domain administrator of all its User Accounts. One of the Client’s User Account will have domain administrator powers and as such, will have access to your User Account information (including your email and other data). The Client domain administrator may be able to view statistics regarding your account, like statistics regarding Interactions you choose to use, change your UA password, suspend or terminate your UA access, access or retain information stored as part of your UA, receive your UA’s information in order to satisfy applicable law, regulation, legal process or enforceable governmental request, and restrict your ability to delete or edit information or privacy settings. Please refer to your domain administrator’s privacy policy for more information.

With payment or other service providers, for external processing. Digiteka engages service providers to perform functions and provide services to us in the United States, in the European Union, and in other countries, notably for online payments of License royalties or online purchases of Additional Services. We may share your private personal information with such service providers subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions. We share your Payment Information with payment services providers to process payments; prevent, detect and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance of credit or debit cards. We may share your credit or debit card number with payment services providers or card networks to monitor card transactions at participating merchants and track redemption activity for the purposes of providing card-linked services. With public authorities and law enforcement entities for legal reasons. Notwithstanding anything to the contrary in this Policy, we may preserve or disclose your information if we believe that it is reasonably necessary:

  • to comply with a law, regulation, legal process, or enforceable governmental request;
  • to protect the safety of any person’s or entity’s rights, notably its intellectual property rights or as part of Digiteka policy against cyber-bullying, as required or permitted by law;
  • to detect, prevent or otherwise address fraud, security or technical issues; and
  • to enforce terms and conditions of your applicable Licence and SLA, including investigation of potential violations.
However, nothing in this Privacy Policy is intended to limit any legal defenses, rights or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Aggregate data. We may share non-personally identifiable information publicly and with our partners – like publishers, other Clients or connected sites. For example, we may share information publicly to show trends about the general use of our services and we may share the aggregate statistics about our Clients’ purchases of Additional Services or about the Authorized Users’ Software activity for the purposes of (i) Software updates and (ii) marketing or promotion.

Company transfers. In the event that Digiteka is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, and that the Software and/or the website services are part of the transaction, we will continue to ensure the confidentiality of any personal information and give notice to affected Authorized Users before personal information is transferred or becomes subject to a different privacy policy. For the purposes of said transaction, we may also disclose information about our Clients to our corporate affiliates in order to help provide, understand, and improve our Services and our affiliates’ services.

  1. THIRD-PARTY SERVICES PROVIDERS AND INTERNATIONAL TRANSFERS OF PERSONAL DATA
Digiteka operates in different countries and processes personal information on the servers of its third-party service providers, notably Amazon Web Services, which may be located in a different country from where you live. By visiting our website and providing us with data, including but not limited to your personal information, you acknowledge and agree that due to the international dimension of our company, we may use the data collected in the course of Software’s or website’s use for the purposes identified in this policy or in other communications with you, or to transfer the information to selected third parties which may be outside your resident jurisdiction, and especially data processors.

As such, your personal data may be transferred to and processed in countries around the world, including countries outside the European Union. Digiteka will however take steps to ensure your personal data is transferred and processed securely, in accordance with European Union requirements.

As of the date of this Privacy Policy, all third-party data processors, namely Amazon Web Services, Google Analytics and OVH comply with EU laws and regulations on personal information and with the United States – European Union Safe Habor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement, ensuring an adequate level of protection.   • Google Analytics: please see Google’s dedicated webpages at How Google uses data when you use our partners’ sites or apps and on its Data privacy & securitycenter. Google Analytics terms of service prohibit sending personally identifiable information to Google Analytics. Website users that don’t want their data reported by the Google Analytics JavaScript can install the Google Analytics opt-out browser add-on, which is available for most modern browsers. Google Analytics do provide Digiteka with a geolocation service that identifies the countries of the visitors accessing its website.
  • Amazon Web Services: please see Amazon’s Privacy Policy here. Digiteka may specify the regions in which its content will be stored and accessible by its Client’s Authorized Users and by the website visitors, and Amazon will not move such content without notifications, unless required to comply with the law or requests of governmental entities. In order to provide Digiteka with uninterrupted access and use of its services, OVH operates from several countries through its subsidiaries, which all apply and respect its binding corporate rules compliant with European laws and regulations on personal data.   1. INFORMATION SECURITY
Digiteka aims to maintain its services in a manner that protects its Software, its service and the personal information of its Authorized Users from any security breach, and especially against accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

Our third-party service providers comply with the highest security certifications for their security standards, protocols and procedures.

Untitled

The Client expressly acknowledges that it shall be the Client’s sole and exclusive responsibility to make and maintain secure and complete back-up copies of Client data on a regular basis (based on the important or critical value that the Client attaches to such Client data), so as to ensure the Client facilitates the prompt restoration of in the event of any loss of or damage to the Client data on the Software.

Whenever it assumes the role of a data controller or processor, by example by using the Software offline or on its own servers/networks or for the purposes of Maintenance Services, the Client is responsible for complying with all legal requirements, including applicable privacy laws and regulations, relating to the collection, storage, use, processing and transfer of personal data through the use of the Software. The Client shall then give access to Digiteka and Digiteka shall process, as a data processor, any personal data that may be required in order to provide Maintenance Services pursuant to the terms of separate agreements, when applicable.

Digiteka comply with the IAB Standards guidelines, namely VAST 3.0/VPAID 2.0

  1. WHEN THIS PRIVACY POLICY APPLIES
Our Privacy Policy applies to all of the services offered by Digiteka on the Software and on Digiteka website, but excludes services that have separate privacy policies that do not incorporate this Privacy Policy. Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites linked from our services or in this Privacy Policy. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our services, and who may use cookies, pixel tags and other technologies to serve and offer relevant ads.

  1. COMPLIANCE AND COOPERATION WITH REGULATORY AUTHORITIES
We regularly review our compliance with our Privacy Policy. When we receive formal written complaints, we will contact the person who made the complaint to follow up. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve with our users directly.

  1. CHANGES
Digiteka reserves the right to make changes to and update its Privacy Policy from time to time by posting a new version on this page or on another dedicated page. The new version will become effective as of the date of last modification indicated at the top of the Privacy Policy. We will not reduce your rights under this Privacy Policy without your explicit consent and if the changes are significant, we will provide you with a more detailed notice which will be submitted to you on your next login to the Software online access.

We will also keep prior versions of this Privacy Policy in an archive for your review.

VOCABULARY

“Access to your personal information” means, for example within the Software, that you can quickly and easily see some of the personal data associated with your User Account.

“Aggregate data” means that Digiteka may collect, mostly through Google Analytics, then share with its Clients, aggregated, non-personally identifiable information publicly.

“Authorized User” or “AUs” means any and all Client personnel, management, agent or subcontractor authorized to access and to use the Software by ways of a dedicated User Account in order to create and publish Projects used to generate Interactive Videos.

“Client” means any entity authorized to use the Software in compliance with the terms and conditions of all agreements of the contract with Digiteka, including but not limited to, the Software applicable license and service level agreement.

“Collect personal information” means that Digiteka collects personal information about each Client’s Authorized Users and about the visitors of its website, whether provided by the Client or collected automatically by the Software, including your usage data and preferences, messages, photos, videos or other content accessible on the Software or on Digiteka website, for example videos of other Users.

“Device identifiers” means identifiers which let Digiteka know which unique device you are using to access our services, which can be used to customize our service to your device or analyze any device issues related to our services.

“Interaction” means a pre-assembled set of programming elements (hotspots, pop-ups or widgets) run by the Software to interact with the video with which they are associated in each Project, at a specific time code of the video.

“Interactive Video” means the deployment of a Project on the Client’s targeted videos through the use of the Software’s rendering engine in order to display all its Interactions.

“Legal process or enforceable governmental request” means that Digiteka regularly receives requests from governments and courts around the world to hand over visitors’ or Authorized Users’ data. By complying so, Digiteka observes the applicable laws and regulations in the European Union.

“Project” means a cloud-based application developed by the Client through the use of the Software, which allows linking a video to additional contents through the use of one or several Interactions. The Project is then used by the Software’s rendering engine to display the Interactive Video.

“Third-party service providers” means any and all service providers through which Digiteka runs and operates the website, the Software and its Maintenance and Additional Services, including but not limited to, payment services to enter into a License Agreement or to make other Software-dedicated purchases.

“User Account” means the account by which the Client and/or any third party authorized by the Parties may access and use the Software for the creation and development of the Projects as well as the deployment of Projects to generate Interactive Videos.
